Compensation for Occupational Injuries and Diseases Act 130 of 1993

NOTICE ISSUED BY THE COMPENSATION COMMISSIONER

The Compensation Commissioner reminded employers to submit all the outstanding Return of Earnings (ROEs). The Compensation Fund will perform an estimation for all outstanding ROEs before 31 January 2022 and issue a Notice of Assessment to Employers with a legal obligation if the return of earnings is not submitted. The Compensation Fund will impose a 10 % penalty on the final assessment for those Employers who fail to submit the ROEs by the due date. Railway Safety Regulator Act 16 of 2002

NOTIFICATION OF THE PUBLICATION OF THE DRAFT VERBAL SAFETY CRITICAL COMMUNICATION STANDARD FOR PUBLIC COMMENTS

The acting Chief Executive Officer of the Railway Safety Regulator (RSR) published for comments the draft Verbal Safety Critical Communication Standard. Interested and affected Railway Stakeholders were invited to submit their written comments within 60 days from the date of publication of this Standard in the Government Gazette, for consideration by the RSR in the development and finalisation of this Standard. Disaster Management Act 57 of 2002

TERMINATION OF NATIONAL STATE OF DISASTER (COVID-19)

The Minister of Cooperative Governance and Traditional Affairs terminated the national state of disaster which was declared on 15 March 2020. All regulations and directions made in terms of section 27(2) of the Act pursuant to the declaration of the national state of disaster to deal with COVID-19, were repealed with immediate effect, save for the following:

a) Regulation 67 – Mandatory protocols when in a public place
b) Regulation 69 – Gatherings
c) Regulations 75 – Partial re-opening of borders
d) Directions which provide for Social Relief of Distress Grant
e) Directions which provide for the extension of the validity period of a learner’s license, driving license card, license disc, professional driving permit and registration of a motor vehicle; and
f) The Regulations in Chapter 8 and the Directions in terms thereof, which provide for a COVID-19 Vaccine Injury No-Fault Compensation Scheme.

The regulations and directions in (a) to (e) above shall continue to operate for a period of one month from 4 April, whereupon they will automatically lapse.

The regulations and Directions referred to in (f) will continue to operate and be in force until terminated in terms of Regulation 100 of Chapter 8.

DIRECTIONS ON THE ESTABLISHMENT OF A COVID-19 VACCINE INJURY NO-FAULT COMPENSATION SCHEME

The Minister of Health published Directions on the establishment of the COVID-19 Vaccine Injury No-Fault Compensation Scheme, in terms of Chapter 8 of the Regulations made under the Disaster Management Act 57 of 2002. REVOCATION OF THE CLASSIFICATION OF THE COVID-19 PANDEMIC AS A NATIONAL DISASTER

CODE OF PRACTICE: MANAGING EXPOSURE TO SARS-COV-2 IN THE WORKPLACE, 2022

The Minister of Employment and Labour issued the abovementioned Code of Good Practice in terms of section 203(2A) of the Labour Relations Act 66 of 1995 w.e.f the date of lapsing of the Declaration of a National State of Disaster declared under GN313 of 15 March 2020. Employment Equity Act 55 of 1998

THE CODE OF GOOD PRACTICE ON THE PREVENTION AND ELIMINATION OF HARASSMENT IN THE WORKPLACE

The Minister of Employment and Labour repealed the Amended Code of Good Practice on the Handling of Sexual Harassment Cases in the Workplace, 2005, which was published under GN 1357 on 4 August 2005 and replaced it with the Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace. Occupational Health and Safety Act 85 of 1993

NOTICE REGARDING IMPLEMENTATION OF REGULATIONS 14, 14A, 14B, 14 C AND 14D OF THE REGULATIONS FOR HAZARDOUS CHEMICAL AGENTS, 2021, AS AMENDED.

The Chief inspector in terms of section 27(1) of the abovementioned Act granted the following temporary exemption: From 29 September 2022, manufacturers and/or suppliers of chemicals may continue to supply existing stock-in-trade that are non-GHS (Globally Harmonised System for the classification and labelling) compliant, provided that the chemical was manufactured or imported (landed and not in transit) prior to the 29 September 2022. The exemption will be for a period of 12 months, ending 30 September 2023, when all labelling and SDS (Safety Data Sheet) shall be GHS compliant.

NATIONAL AVIATION SECURITY PROGRAM

The Minister of Transport approved the National |Aviation Security Program (NASP) 200 in terms of Section 109 of the Civil Aviation Act, 2009. The commencement date of the amended NASP 2022 was 12 August 2022 and replaces the NASP that came into effect on 11 May 2012. Application for access to the amended NASP 2022 must be in writing to the Aviation Security: Executive, at South African Civil Aviation Authority. The South African Veterinary Council withdrew and substituted the rules relating to the practising of Para-Veterinary profession of Animal Health Technician as published in Government Gazette number 30184, GNR.770, on 24 August 2007. RULES RELATING TO THE VETERINARY PROFESSIONS

The South African Veterinary Council repealed rules 33 to 42 of the rules pertaining to the veterinary professions, as published in Government Gazette notice 1082, Government Gazette number 39380, on 9 November 2015. The Minister of Agriculture, Land Reform & Rural Development approved the repeal of the said rules, w.e.f date of publication of the Notice in the Government Gazette.
