NATIONAL RAILWAY SAFETY REGULATOR ACT 16 OF 2002

RAILWAY SAFETY STANDARDS DEVELOPMENT REGULATIONS, 2022

The Minister of Transport made the abovementioned Regulations, which was published under Government Notice 1284, Government Gazette 46917 of 16 September 2022.

COMPENSATION FOR OCCUPATIONAL INJURIES AND DISEASES ACT 130 OF 1993

INCREASE IN MONTHLY PENSIONS

The Minister of Employment and Labour prescribed an increase in monthly pensions with 4.5 % with regards to accidents which occurred before 31st March 2022 as well as occupational diseases which were diagnosed before 31 March 2022. The increase of 4.5 % is with effect from 1 April 2022. Published under General Notice 1275, Government Gazette 46884 of 9 September 2022.

NATIONAL RAILWAY SAFETY REGULATOR ACT 16 OF 2002

AMENDMENT OF REGULATIONS ON NOTIFIABLE RAILWAY OCCURRENCES, 2022

The Minister of Transport intends to replace Appendix A Table 1 as published on 3 June 2022. Interested persons were invited to submit comments on the draft Appendix A Table 1 to the Director-General, Department of Transport, at machakam@dot.gov.za. PUBLICATION OF FEES FOR COMMENTS

The Minister of Transport published the determination of the fees that the Railway Safety Regulator must charge for safety permits. ELECTRICITY REGULATION ACT 4 OF 2006

LICENSING EXEMPTION AND REGISTRATION NOTICE FOR PUBLIC COMMENT

The Minister of Mineral Resources and Energy intends to amend Schedule 2 to the Act regarding Exemption from obligation to apply for and hold a license. He further intends to determine that a person who operates a generation facility as contemplated in item 3, a distribution facility as contemplated in item 3.2 or a person who performs the activities of a reseller as contemplated in item 3.5 of the schedule, must register with the Registrar.

The Portfolio Committee on Transport in the National Assembly agreed to amendments on the National Road Traffic Amendment Bill [B7-2020]. These amendments were published on 27 September 2022.

REGULATIONS RELATING TO THE QUALIFICATIONS FOR THE REGISTRATION OF OPTOMETRISTS

REPEAL OF VARIOUS RULES

The Health Professions council of South Africa repealed the following rules:
Rules for the registration of speech and hearing correctionists, 1985 – Board Notice 324, Government Gazette 46884 of 9 September 2022.
Rules for the registration of audiometricians, 1976 – Board Notice 325, Government Gazette 46884 of 9 September 2022.

REGULATIONS DEFINING THE SCOPE OF THE PROFESSION OF MEDICAL ORTHOTICS AND PROSTHETICS

The Minister of Health intends to make the abovementioned regulations. Interested persons were invited to submit any substantiated comments or representations on the proposed regulations to the Director-General of Health, at mihloti.mushwana@health.gov.za, within three months of the date of publication of the Notice in the Government Gazette. AMENDMENT OF REGULATIONS MADE IN TERMS OF THE ACT

TOBACCO PRODUCTS AND ELECTRONIC DELIVERY SYSTEMS CONTROL BILL, 2018

The Minister of Health intends to introduce the Tobacco Products and Electronic Delivery Systems Control Bill, 2018, in the National Assembly shortly. The Bill provides for –
• 100 % smoke free for indoor public places and certain outdoor areas;
• the ban on sale of cigarettes through vending machines;
• plain packaging with graphic health warnings or pictorials;
• ban on display at point-of-sale;
• regulation and control of Electronic Nicotine Delivery Systems and N0n-Nicotine Delivery Systems.

INVITATION FOR WRITTEN REPRESENTATIONS

The National Minimum Wage Commission will publish its annual report and recommendations concerning possible adjustment to the national minimum wage to the Minister of Employment and Labour later in 2022. These recommendations will be considered by the Commission before it publishes its annual report and recommendations.
