CONTROL MEASURES RELATING TO FOOT AND MOUTH DISEASE

The Minister of Agriculture, Land Reform and Rural Development repealed the Control Measures relating to foot and mouth disease as prescribed in GN 2075 of 10 May 2022 and GN 2391 of 18 August 2022 and prescribed the new Control Measures which was published under Government Notice 2465, Government Gazette 46870 of 8 September

NATIONAL ENVIRONMENTAL MANAGEMENT ACT 107 OF 1998

CONSULTATION ON THE INTENTION TO EXCLUDE THE DEVELOPMENT AND EXPANSION OF SOLAR PHOTOVOLTAIC INSTALLATIONS FROM THE REQUIREMENT TO OBTAIN AN ENVIRONMENTAL AUTHORISATION BASED ON COMPLIANCE WITH AN ADOPTED ENVIRONMENTAL MANAGEMENT INSTRUMENT

The Minister of Forestry, Fisheries and the Environment intends to exclude the development and expansion of solar photovoltaic facilities, including any associated activity or infrastructure, from the requirement to obtain environmental authorisation. The exclusion is provided for in terms of section 24(2)(e) of the National Environmental Management Act 107 of 1998, subject to compliance with an adopted Environmental Management Instrument as set out in the said Notice. Members of the public are invited to submit written comments or input, within 30 days from the date of publication of the Notice in the Government Gazette, to dfischer@dffe.gov.za. CONSULTATION ON THE INTENTION TO ADOPT THE NATIONAL WEB BASED ENVIRONMENTAL SCREENING TOOL AS AN ENVIRONMENTAL MANAGEMENT INSTRUMENT

The Minister of Forestry, Fisheries and the Environment intends to adopt the National Web Based Environmental Screening Tool in terms of Regulation 4(1) and 7 of the Regulations Laying down the procedures to be followed for the adoption of Spatial Tools or Environmental Management Instruments, 2019. The National Web Based Environmental Screening Tool is a spatially enabled tool which has been developed to identify areas of very high, high, medium and low environmental sensitivities on a particular site. Environmental sensitivity ratings are intended to be used to exclude activities identified in terms of section 24(2)(a) and (b) of the National Environmental Management Act, 1998, from the requirement to obtain environmental authorisation prior to commencement, as contemplated in terms of sections 24(2)(c) and (e) of the Act. Members of the public were invited to submit written comments within 30 days from the date of the publication of the Notice in the Government Gazette, to https://screening.environment.gov.za.

NATIONAL WATER ACT 36 OF 1998

WITHDRAWAL OF NOTICE OF INTENTION TO DISESTABLISH LEBALELO WATER USER ASSOCIATION (LWUA) AND INCORPORATE IT INTO LEPELLE NORTHERN WATER (LNW)

The Minister of Water and Sanitation withdrew the Gazette Notice No.1340, which was published in Government Gazette 40375 on 28 October 2016, that was intended to disestablish the Lebalelo Water User Association and directed that the operations and functions of Lebalelo Water User Association be transferred to Lepelle Northern Water. Published under Government Notice 2557, Government Gazette 46991 of 30 September 2022.

BY-LAWS:

Madibeng Local Municipality Integrated Waste Management By-Law, published under LAN 262, PG 8417 of 27 September 2022. This by-law repeals the Waste Management By-Law, 2009

Bojanala Platinum District Municipality Public Health By-Law, published under LAN 261, PG 8416 of 20 September 2022. This By-Law repeals the Municipal Health Services By-Law, 2011.

City of Johannesburg Outdoor Advertising By-Law, 2009. The City of Johannesburg indicated in an e-mail communication and in a notice on their website that they are currently using the Outdoor Advertising By-laws, 2009, since the Outdoor Advertising By-law, 2018, was declared invalid and unconstitutional by SAPOA & Other v COJ 2018 case number: 19656/18. The 2018 By-law was, however, never formally repealed by publication in the Provincial Gazette.
