National Heritage Resources Act 25 of 1999
REGULATIONS IN ACCORDANCE WITH THE PROVISIONS OF SECTION 9 OF THE NATIONAL HERITAGE RESOURCES ACT, NO 25 OF 1999
Regulations in accordance with the provisions of section 9 of the National Heritage Resources Act, No. 25 of 1999 (“NHRA”) that replaces the previous Regulations, No. 40691 of 17 March 2017, in terms of section 9(3)(a) of the NHRA, were published for public comments. The main objective of these Regulations is to provide standards for conservation and maintenance of heritage resources that are in the control of all branches of the State and state supported bodies. This notice on the updated/amended section 9 Regulations is for public comment from all interested and affected parties. The commenting period commenced when the notice was published, until 18 February 2022. National Environmental Management: Waste Act 59 of 2008
NATIONAL NORMS AND STANDARDS FOR TREATMENT OF ORGANIC WASTE
The Minister of Forestry, Fisheries and the Environment published the National Norms and Standards for the treatment of organic waste, for implementation. The Norms and Standards are aimed at reducing the amount of organic waste that would normally go to landfill sites and, as such, waste will be diverted from landfill to facilities that will be treating it for beneficial use. The Department of Forestry, Fisheries and the Environment requested information on chemicals to be recommended for listing at the 10th Conference of the Parties (COP 10) under the Stockholm, and Rotterdam Conventions. Any company which manufactures, uses, sells, imports or exports, and/or is in possession of chemicals, indicated in the schedule to the notice, which are to be recommended for listing at the Stockholm and Rotterdam Conventions, are invited to submit all the information requested in the schedule to the Department of Forestry, Fisheries and the Environment within the 30 days of publication of the notice in the Gazette. National Environmental Management: Waste Act 59 of 2008
NOTICE OF EXTENSION OF REPORTING PERIOD BY IDENTIFIED PRODUCER RESPONSIBILITY ORGANISATIONS AND PRODUCERS TO THE EXTENDED PRODUCER RESPONSIBILITY ONLINE SYSTEM UNTIL 31 AUGUST 2022
The Minister of Forestry, Fisheries and the Environment, published the Extended Producer Responsibility Regulations, 2020 and Notices regarding the establishment and implementation of extended producer responsibility schemes for the electrical and electronic equipment sector, the lighting sector and the paper, packaging and some single-use products on 5 November 2020 under Notice 1184, GG 43879.
The implementation of the EPR schemes was deferred for a period of 6 months to 5 May 2021 in order to enable the affected sectors some time to prepare for implementation. From 5 May to 5 November 2021, the registration of the producers and producer responsibility organisations took place.
Regulation 8 of the Extended Producer Regulations, 2020 requires Producer Responsibility Organisations and Producers that implement their own Extended Producer Responsibility schemes to submit their interim performance reports on or before 31 July 2022.
The online system experienced technical challenges and delays which have since been resolved. The online report system went live on Wednesday, 20 July 2022. The reporting period in terms of Regulations 8 of the Extended Producer Regulations, 2020 was extended until 31 August 2022. The EPR online reports can be uploaded on http://sawic.environment.gov.

CONSULTATION ON THE DRAFT NATIONAL REGULATIONS FOR THE MANAGEMENT OF MERCURY IN SOUTH AFRICA
The Minister of Forestry, Fisheries and the Environment intends to publish the draft Regulations for the Management of Mercury in South Africa. The draft Regulations are intended to domesticate the Minamata Convention on Mercury, of which South Africa is a party and ratified in 2019. The objectives of the draft Regulations are in line with the objectives of the Convention. The purpose of the draft Regulations is to eliminate the anthropogenic emissions and releases of mercury, to limit processes emitting and releasing mercury into the environment, to phase out mercury added products, to phase down dental amalgam and to regulate mercury storage facilities and trade. Members of the public were invited to submit, within thirty days of publication of the Notice in the Government Gazette written representations or objections to the proposed draft Regulations to tsebego@dffe.gov.za. Draft 8th National Greenhouse Gas Inventory Report for the Republic of South Africa
CONSULTATION ON THE DRAFT 8th NATIONAL GREENHOUSE GAS INVENTORY REPORT FOR THE REPUBLIC OF SOUTH AFRICA
The Minister of Forestry, Fisheries and the Environment published the draft 8th National Greenhouse Gas Inventory Report, for public comment. eto. The National Greenhouse Gas Inventory Report will eventually form part of the Fifth Biennial Update Report to the United Nations Framework Convention on Climate Change (UNFCCC). South Africa is required by the UNFCCC to provide in its national inventory, on gas-by-gas basis, and its units’ mass, estimates of anthropogenic emissions of carbon dioxide (CO2), methane (CH4) and nitrous oxide (N2O), by sources and removals by sinks. An accurate, complete and updated greenhouse gas emissions inventory is a good foundation for effective mitigation responses. The Minister of Forestry, Fisheries and the Environment amended the enabling provision for the regulations laying down the procedure to be followed for the adoption of spatial tools or environmental management instruments, as published under GN 542, GG 42380 of 5 April 2019, by substitution for section 24(5)(Bb) of section 24(5)(Ba) OF THE National Environmental Management Act, 1998. The reason for the amendment is that section 24(5)(bB) of the Act will be repealed by the National environmental Management Laws Amendment Act, 2002 when the Act comes into operation. Section 24(5)(bA) provides that the Minister or an MEC with the concurrence of the Minister may make regulations consistent with section 24(4), laying down the procedure to be following for the preparation, evaluation, adoption and review of prescribed environmental management instruments and is therefore an appropriate enabling provision. The Minister of Water and Sanitation declared that the Vaal-Orange Catchment Management Agency (CMA) is established through the extension of the boundaries and operational area of the Vaal River CMA to include the Orange Water Management Area. The CMA shall be named Vaal-Orange Catchment Management Agency. The area of operation of the Vaal Orange CMA includes the previous Orange Water Management Area and Vaal Water Management Areas as pronounced in the National Water Resource Strategy. The protocol provides the criteria for the specialist assessment and minimum report content requirements for determining impacts on Cape Vultures associated with the development of onshore wind energy generation facilities, which require environmental authorisation. This protocol must be read with either the avifaunal or animal species protocol, whichever is applicable to the specific application under consideration. The assessment and reporting requirements of this protocol are associated with a collision risk potential identified by the national web based environmental screening tool (screening tool) for Cape Vultures. The relevant data in the screening tool has been provided by the FitzPatrick Institute of African Ornithology of the University of Cape Town. The Regulations apply to importers and exporters of the chemicals listed in Annex III of the Rotterdam Convention to pesticides and industrial chemicals controlled under South African legislation. THE REVISED NATIONAL LIST OF ECOSYSTEMS THAT ARE THREATENED AND IN NEED OF PROTECTION
The Minister of Forestry, Fisheries and the Environment published the Revised National list of Ecosystems that are Threatened or in need of Protection. The primary implication of the aforementioned list is that it is linked to Listing Notice 3, published under the National Environmental Management Act, 1998. Some of the activities in Listing Notice 3 require environmental authorisation when they are carried out in a threatened ecosystem as identified in the list. The List of Ecosystems has also been used throughout South Africa as a decision-making support tool, especially in environmental authorisation application processes and to inform bioregional planning.
